Almost ten years ago, Birkenstock moved to the Italian dish: the Italian family company Rafting Goldstar was accused of copying its own trademark in the form of sandal sole. The legal dispute over several court courts over the years: In September 2018, the European Court of Justice of the sole spoke “missing special features”, which is why it could not be entered as a trademark and the lawsuit was contradicted. As a result, Birkenstock was not satisfied with the judgment and also complained of courts in Benelux, Germany and Paris. In the Benelux countries, the decision of the European Court of Justice was followed in 2018, followed in Germany the same judgment 2024. Now Rafting Goldstar announced that he has also achieved a judgment in the French Court of Justice in favor of his own brand. Only the judgment of the Italian court second instance is still pending.
