Temu is said to withdraw the business partners who sell goods via the platform. This is the allegations of the German trade association (HDE), which is now approaching the Federal Cartel Office. The Chinese fast-selling platform would not only determine that the prices of the individual dealers should be a maximum of 85% of the price that a dealer requires for a comparable product on other sales platforms. Temu, too, also reserves the right to decide on the amount of the final sales prices.
Overall, Temu violated European and national law. Provisions of prices are not observed, which comes to light, especially when advertising. The law and product security provisions would not be met either.
“Anyone who offers and sells goods in this country must also adhere to our rules and laws,” said HDE President Alexander von Preen. “The domestic trading companies invest a lot of money in compliance with environmental and consumer protection requirements and finance the community with their tax payments. In contrast, Chinese platforms such as Temu sell were massive on our market without adhering to the applicable regulations.”
The HDE now wants to proceed with a complaint with the Federal Cartel Office against the platform that is contrary to antitrust. For this purpose, work was made together with the Noerr law firm and a complaint was written based on documents and test purchase results.
