Cryptocurrency company is denounced in Argentina for possible fraud

The National Securities Commission (CNV) of Argentina filed a criminal complaint against Atomic 3 SA, a company registered as a supplier of virtual asset services (PSAV), due to suspicions of fraud related to a lithium mining token project in the province of San Juan.

The investigation, which resulted in the complaint, began after receiving multiple reports that alerted about possible irregularities in the atomic 3 SA operation, registered under number 103 in the Official Registry of PSAV.

After reviewing the documentation and consulting with the Ministry of Mining of San Juan, the CNV found that Atomic 3 SA does not have its own permissions for lithium exploitationbut only an exploration permit that is registered in the name of another person or entity.

In addition, the technical reports obtained during the investigation suggest that The chances of finding lithium in the indicated area are minimaland there is no concrete evidence that supports the promotional statements of the company.

From these findings, the CNV determined that the initiative could be hiding a different activity. “Behind this project could be something other than the promoted, which would mean the possible existence of fraud,” said the CNV, according to what reported by local media.

As a result of the investigation, the agency formalized a criminal complaint protected by articles 172 and 177 of the Criminal Code and the Criminal Procedure Code of the Nation, respectively. And besides ordered the preventive suspension of atomic 3 SA as a registered provider of virtual asset services.

This action, based on laws 26,831 and 27,739 that regulate the capital market and the activity of virtual asset services in Argentina, aims to protect investors and prevent the company from continuing to operate until the facts are clarified.

Atomic 3 SA, legally constituted in Paraguay, was registered as PSAV in Argentina in January 2025. But, with the suspension of such a function before the complaint, the company cannot operate and offer services linked to virtual assets in the Argentine market until its situation is resolved.

Through its website, the company holds which provides tokens representing mining assets backed by lithium reserves certified under rules or 43-101. Thus, he points out that “they democratize access to investment in natural resources.”

This case is part of regulatory changes for the ecosystem in Argentina. As Cryptonotics reported in March, the CNV implemented Resolution No. 1058/2025, a regulatory framework that forces PSAV, including cryptocurrency exchanges, to register and comply with strict financial, operational and transparency requirements.

This regulation seeks to professionalize the sector, establishing clear conditions to legally operate, protect investors and raise security standards, through demands such as minimal assets, codes of conduct and protocols for asset custody.
