What is the Insurrection Act?

The Insurrection Act is a very old law of America, which was passed in 1792. Under this law, the US President has the right to deploy the US Army when law and order in a state completely deteriorates and the local administration or courts fail to handle the situation.

However, under normal circumstances another law called the Posse Comitatus Act prohibits the use of armed forces within the country, but the Insurrection Act provides a legal exception to this prohibition. If the President feels that there is a situation of rebellion or rebellion, he can call the army.

There are two main ways of implementing the Insurrection Act-

• If the Governor of any state or its assembly asks for help from the Centre, then this can be implemented. For example – during the Los Angeles riots in 1992, the Governor of California asked for help from the then President.
• If the President feels that there is rebellion or disobedience to federal law in any state, he can himself order to send the army.
• It is written in the law that if the President considers that ‘rebellions, obstructions or unlawful assemblies are taking place against the authority of the Federal Government and it is not possible to enforce the law through the ordinary judicial process, then he can call the armed forces of the state into Federal service.

When are laws enacted against the state?

In 1957, President Dwight Eisenhower used the Insurrection Act to deploy the military against the wishes of the Governor of Arkansas to enforce racial integration in schools. Similarly, in 1962, President John F. Kennedy also used the same law to admit African-American students into educational institutions in southern states.

Donald Trump said that the violent demonstrations that took place in cities like Portland were criminal insurrection. He said that if the governor or mayor does not cooperate, he will invoke the Insurrection Act and send the army to restore peace in the cities. His senior adviser Stephen Miller also called it legal insurrection and accused some local governments of weakening their enforcement of federal laws. Legal experts had warned that misuse of this law could threaten the democratic structure.
