The BTE points out that the EUDR will now come into force at the beginning of 2025. A postponement of one year is being discussed, but the EU Council of Ministers and Parliament have not yet agreed to this. The trade association therefore points out that it is expected to start at the beginning of next year. The EUDR affects companies – including traders – that are part of a supply chain that uses resources that could contribute to deforestation.
The BTE sees it as problematic that there are still many ambiguities despite tight deadlines. For example, it is not yet certain whether packaging materials, office equipment or clothes hangers also fall within the scope of the EUDR. There have been additional guidelines in English since October 2nd, and an official German translation is still to be published.
In order to relieve the burden on companies, in addition to the postponement by twelve months, the BTE demands that the responsible national authority implement the regulation in a practical manner. The BTE also calls for the creation of a new product category where products are subject to zero risk. In addition, the duty of care should be transferred to the initial distributor. This would eliminate the documentation and proof requirements for all further stages of the supply chain. Finally, there should be the possibility for safe harbor solutions if, for example, industry solutions can provide proof of certification.
