Indians may benefit from the removal of the per-country cap for an H-1B visa
The current US visa allocation system sets a limit for each country, regardless of companies’ demand for employees. India often faces long delays due to this restriction as a large portion of the global talent pool comes from India. Changes to existing laws are likely to benefit India and other countries with large numbers of skilled workers.
Removing the country cap will speed up the visa process and make it easier for Indian professionals to transition to permanent residency. It would also reduce the job precarity that many foreign workers experience. However, experts stress that if the rules are changed, there will be a need to strike a balance and ensure that the H-1B visa system is not abused. Many fear that this may make the American labor market more competitive and deprive local residents of better opportunities.
The Biden administration also gave relaxation to H-1B visa rules.
This development comes just days after the outgoing US administration announced the relaxation of H-1B visa rules. The administration led by Joe Biden made this easing with the aim of providing more flexibility to employers and workers. The new rules announced by the Department of Homeland Security update the definition and criteria for certain government and nonprofit research positions and organizations that are exempt from the annual statutory limit on H-1B visas. This would make it easier for US companies to hire foreign workers with specialized skills and facilitate a smoother transition from F-1 student visas to H-1B visas.
